These Terms & Conditions (“Terms”) govern access to and use of the Insparted mobile application, its website, content, products, and any related services provided by Insparted (Developer) (“Developer,” “we,” “us,” or “our”). By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.
1. Eligibility
You must be at least 18 years old to use the Services. The app is not intended for children under the age of 18. If you are under 18, you may not use the app.
2. Accounts
To use certain features of Insparted, you may need to create an account, including via Apple Sign‑In or Google Sign‑In. You agree to:
- Provide accurate and complete information when registering and updating your account.
- Keep your login credentials confidential.
- Be responsible for all activity that occurs under your account.
- Notify us promptly at support@insparted.com if you suspect any unauthorized use or account misuse.
We may suspend or terminate accounts that violate these Terms, upload offensive or illegal content, or create risk for the Developer or other users.
3. License to use the app
Subject to these Terms, the Developer grants you a limited, non‑exclusive, non‑transferable, non‑sublicensable, revocable license to download, install, and use the Insparted app solely for your personal, non‑commercial use on your mobile device, in accordance with these Terms and applicable law.
4. Acceptable use
You may use the Services only for lawful purposes and in compliance with these Terms. You must not:
- Violate any applicable law or regulation.
- Engage in harassment, threats, or any form of abusive behavior.
- Post or transmit any content that is offensive, hateful, defamatory, discriminatory, or illegal.
- Infringe intellectual property or other rights of others.
- Use bots, scrapers, or automated tools to access the app except as expressly permitted.
- Attempt to interfere with, disrupt, or compromise the security of the app or its servers.
- Use the Services for spam, fraud, or other malicious activity.
- Reverse engineer, decompile, or otherwise attempt to derive the app’s source code except where permitted by law.
5. User content
You may upload 60‑second challenge videos, photos, and related information (“User Content”). By uploading User Content, you:
- Represent and warrant that you have the right to share such content.
- Confirm that your content does not infringe the rights of others or contain offensive, illegal, or harmful material.
We reserve the right to:
- Remove any User Content that we believe in good faith is offensive, abusive, illegal, or otherwise violates these Terms.
- Issue warnings to users who upload inappropriate content.
- Permanently suspend or terminate a user’s account if they repeatedly upload or share offensive content or otherwise misuse the Services.
6. User permissions and controls
You control your account and can change your display name, profile photo, and privacy settings as provided in the app. You may also manage device‑level permissions (camera, microphone, photo library, notifications) through your iOS or Android settings. If you disable these permissions, some features of the app may not be available to you.
7. Payments and in‑app purchases (future)
At present, there are no in‑app purchases in Insparted. However, the Developer may introduce such features in the future using Apple’s App Store and Google Play Store payment systems. If and when in‑app purchases are added:
- You will be notified of the updated payment terms in the app.
- You authorize the applicable platform (Apple or Google) to charge the relevant fees, taxes, and other charges.
- Refunds will be handled according to the respective App Store’s policies.
These Terms will be updated accordingly at that time.
8. Third‑party services
The Services integrate with third‑party providers such as:
- CloudFlare: for hosting and security.
- Railway: for backend hosting and infrastructure.
- Singular: for attribution and analytics.
- Supabase: for data storage and database management.
These providers have their own terms and policies. You acknowledge that the Developer is not responsible for the availability, performance, or privacy practices of these third parties.
The app is distributed exclusively via the Apple App Store and Google Play Store. You acknowledge that Apple’s terms can be found at https://www.apple.com/legal/internet-services/itunes/dev/stde/terms.html and Google’s terms can be found at https://play.google.com/about/play-terms/. These third‑party terms also apply to the extent relevant to using the app through their platforms.
9. Intellectual property
All rights, title, and interest in the Insparted app, software, design, content, trademarks, and related materials remain the property of the Developer or its licensors. Except for the limited license expressly granted in these Terms, no other rights are granted to you. You may not copy, modify, reverse engineer, or create derivative works from the app except where expressly permitted by law.
10. User responsibility for UGC and moderation
Because the app allows users to upload challenge videos and other User Content, you are responsible for your own uploads. You must not post any offensive, illegal, or harmful content. The Developer may moderate or remove User Content at its discretion and may take enforcement action, including permanent suspension of accounts, against users who repeatedly violate these rules. You agree that the Developer is not liable for the content uploaded by other users.
11. Termination and suspension
The Developer may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if:
- You breach these Terms.
- You upload offensive, illegal, or abusive content.
- You create legal, security, or reputational risk.
- The Services are discontinued or materially changed.
- We are required to do so by law or a third‑party platform.
You may stop using the app at any time. If you wish to delete your account, you may contact support@insparted.com or use any in‑app account deletion process that may be available.
12. Disclaimers
The Services are provided on an “as is” and “as available” basis to the maximum extent permitted by law. The Developer makes no warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non‑infringement, and availability. We do not guarantee that the app will be uninterrupted, error‑free, secure, or suitable for every user’s purpose.
13. Limitation of liability
To the maximum extent permitted by law, the Developer and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities arising out of or related to the Services.
To the maximum extent permitted by law, the total liability of the Developer for any claim arising out of or related to the Services will not exceed the amount you paid to use the app (if any) in the 12 months preceding the claim. Where no payment was made, the Developer’s total liability is capped at the statutory minimum allowed by applicable law.
14. Indemnification
You agree to defend, indemnify, and hold harmless the Developer and its affiliates, officers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses arising out of:
- Your use of the Services.
- Your User Content.
- Your breach of these Terms.
- Your violation of applicable law or the rights of another person.
15. Governing law, jurisdiction, and disputes
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict‑of‑law principles, except to the extent mandatory law requires otherwise. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be brought exclusively before the courts located in the Netherlands, unless the parties otherwise agree in writing or mandatory law provides a different forum.
If you reside in a jurisdiction with mandatory consumer protections, nothing in these Terms limits your ability to rely on those non‑waivable rights or to bring claims in a forum required by applicable law.
16. Applicable law notice for users by region
If the Services are offered internationally, additional mandatory laws may apply depending on where you live or access the Services. The Developer may provide additional notices or region‑specific terms where required by local law (for example, in the EU/EEA or certain U.S. states). To the extent there is a conflict between these Terms and non‑waivable local law, the non‑waivable local law will control only to the extent of that conflict.
17. App store terms
If the app is downloaded from a third‑party app store, such as the Apple App Store or Google Play Store, you acknowledge that:
- These Terms are between you and the Developer (Insparted), not with Apple or Google.
- Apple or Google may have additional rules that apply to the app’s distribution, in‑app purchases, and account management.
- Apple or Google is not responsible for the app’s maintenance, support, or claims, except as required under their own terms.
18. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will indicate the “Last updated” date and, where appropriate, notify you via the app or email. Continued use of the app after updated Terms become effective constitutes acceptance of the updated Terms.
